By accessing or using NoteFest ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all visitors, users, and others who access the Service.

2. Description of Service

NoteFest is a gamified music education platform designed to help beginners learn to read sheet music, understand music theory, and develop fundamental playing skills for stringed instruments including violin, viola, cello, and bass. The Service includes interactive lessons, quizzes, progress tracking, and a skills practice system.

3. User Accounts

You may use certain features of the Service without creating an account (guest mode). To unlock full access, save your progress across devices, and access premium features, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized use of your account
  • Providing accurate and complete information when creating your account

We reserve the right to suspend or terminate accounts that violate these terms.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to any part of the Service or its related systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Scrape, copy, or reproduce the Service's content without our written permission
  • Use automated tools or bots to interact with the Service
  • Impersonate any person or entity or misrepresent your affiliation

5. Subscriptions and Payments

NoteFest offers both free and paid subscription tiers. By subscribing to a paid plan, you agree to the following:

  • Subscription fees are billed in advance on a monthly or annual basis
  • Payments are processed securely through Stripe
  • You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
  • We do not provide refunds for partial billing periods
  • We reserve the right to change pricing with at least 30 days' notice

6. Intellectual Property

All content on the Service β€” including but not limited to text, graphics, music, audio, animations, lesson content, and software β€” is owned by or licensed to NoteFest and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

7. User-Generated Content

If you submit feedback, suggestions, or other content to NoteFest, you grant us a non-exclusive, royalty-free license to use, reproduce, and incorporate that content to improve the Service. You retain ownership of any content you submit.

8. Children's Privacy

NoteFest is designed for learners of all ages, including children. We are committed to complying with applicable children's privacy laws. If you are under 13 years of age, you must have a parent or guardian's consent to create an account. Parents and guardians who believe their child has submitted personal information without consent should contact us at violinexplained@gmail.com.

9. Disclaimers

The Service is provided "as is" without warranties of any kind, either express or implied. NoteFest does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranties regarding the accuracy or completeness of any content on the Service.

10. Limitation of Liability

To the fullest extent permitted by law, NoteFest shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

11. Changes to Terms

We may modify these Terms of Service at any time. We will notify you of material changes by posting the new terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated terms.
